What is exclusive use?
You might have an exclusive right to
use a part of the common property, such as a patio that adjoins your
section, but you don't own that patio outright - and never will.
Your right of exclusive use is
granted to you by all the owners in the sectional title scheme. No other
section owner has the right to use your exclusive-use-area, even though
they may own a share in it. Your "exclusive use" is a real right that
might be registered in the deeds office, if the body corporate agrees.
You
should note that management rule 68 which, in addition to outlining the
duties of owners delineated in Section 44, states that "an owner shall not
use his section, exclusive use area or any part of the common property, or
permit it to be used, in such a manner or for such purpose as shall be
injurious to the reputation of the building". |
