1. ANIMALS, INSECTS, REPTILES AND BIRDS (1) An owner shall not, without the consent in writing of the trustees, which approval may not unreasonably be withheld, keep any animal, insect, reptile or bird in a section or on the common property. (2) When granting such approval, the trustees may prescribe any reasonable conditions and/or Directives in addition to the following conditions: (a) No dogs or cats shall be allowed on the common property unless controlled on a leash. Dogs must be registered at the body corporate, must wear identity tags and not create a nuisance with barking. Cats are to be neutered, registered at the body corporate, and have to wear identity tags. (b) Owners shall ensure that their animals do not foul the common property, nor cause a nuisance to any other owner or occupier. (c) Owners shall ensure that their animals, insects, reptiles or birds do not cause harm or injury to any owner or occupier, or damage to their property or to the common property. (3) The trustees may withdraw approval granted in terms of sub-rule (1) in the event of breach of a condition or Directive prescribed in terms of sub-rule (2), upon which the owner or occupier has to remove the animal, insect, reptile or bird from the section and the common property in accordance with Conduct Rule 17 (1)(a). (4) Notwithstanding the provisions of sub-rule (3), upon the breach of, or non-compliance with, the provisions of this Rule, the owner of the relevant section may become liable for a fine imposed in terms of Conduct Rule 18. |
